Is it considered copying if you someones picture in top5 but it is deleted.

Jaybuddy, you often enjoy copying some other artist. IMO you do it in a very correct manner, giving credits to the original. I find this way of copying as a tribute to an appreciated pic. Here in TD often happens that we copy each other, enjoying both (the first artist and the copier) of this practice. In past we had even some challenge about copying and remaking.
In copying, the "copier" artist anyway put something of his/her inner sense of art, and it could be an interesting experience for the "copied" artist.

Sometime an artist delete an old pic, but it remains in the top5. I can't see any difference in this case, if the pic is copied.

I think that the only important thing is giving credit.
